A trademark expert witness often plays a key role in the successful resolution of any trademark infringement case. Survey evidence provided by such an expert can demonstrate whether a mark is subject to protection or not, and render an entire claim valid or invalid. Michael Atkins, active trademark lawyer and shareholder in the firm Graham & Dunn, has written a short guide on how to locate trademark expert witnesses.
