Expert Witness Requirements Upheld in Georgia

Expert witnesses in civil cases in Georgia will continue to be subject to more rigid requirements than their counterparts in criminal cases. The Georgia Supreme Court recently upheld Section 7 of Georgia's 2005 tort reform law in Mason v. Home Depot, which mandates this very thing. In Mason, the Court concluded that the provision mandating more stringent requirements for experts in civil cases did not violate the Equal Protection and Due Process Clauses.
